In Azerbaijan, marital infidelity can cost up to 20 thousand manats

In Azerbaijan, marital infidelity can lead to legal consequences. The affected party has the right to demand moral compensation.

Through the court, one can protect rights arising from personal and family relationships. The amount of compensation is determined based on the extent of the damage caused and the impact of the incident. This issue holds significant importance from both a legal and social perspective.

Lawyer Turan Abdullazade told Demokrat.az that Azerbaijan has already implemented the possibility of receiving compensation for infidelity:

“The new ruling will take effect in 2026 and does not apply to past cases. It only pertains to relationships established after the adoption of this law. In such situations, the affected party can file a lawsuit against the unfaithful spouse for violating personal rights.

The key is to prove the fact of infidelity. Evidence can include video recordings, photographs, correspondence, as well as documents in the case of a child from an extramarital relationship. The affected party has the right to file a claim for violation of personal rights and insult to dignity.”

The lawyer added that when considering a case for moral compensation, a person can independently assess its amount, but the sum should not be excessive:

“The compensation amount can range from 10 to 20 thousand manats. When determining the amount, factors such as age, gender, sensitivity, and the degree of emotional distress are taken into account. The timing of the lawsuit also matters: if the claim is filed immediately after the incident, the court perceives it as a significant impact; if several years have passed, the degree of moral damage and the court’s trust may be lower. Although the law does not require a mandatory divorce, if the spouses do not divorce, it is considered an internal acknowledgment of the fact of infidelity,” the lawyer noted.
