Court rejects Trump's order banning US citizenship by birth

The US Supreme Court has declared invalid the order of American President Donald Trump limiting the right to citizenship by birth.

As TASS reports, five of the six judges recognized that this right is guaranteed by the US Constitution. Another in his conclusion indicated that he disagrees with such an interpretation, however, considered the presidential order invalid, since it contradicts federal legislation.

The order limiting the granting of US citizenship by right of birth was signed by Trump after his inauguration on January 20, 2025. It instructed government agencies to deny citizenship to children born in the US whose parents are staying there illegally, as well as in cases where the newborn's mother entered the country on temporary grounds, including under a visa-free regime with another state or on a student, work, or tourist visa, and the father is not a US citizen or holder of a residence permit in the US.

The head of state himself explained his order by saying that the norm on citizenship by place of birth was originally "intended for the children of slaves and their protection." "It is not for billionaires from China or other countries," he emphasized.

The constitutional amendment on the right to citizenship by birth was adopted after the Civil War in the US (1861-1865), thanks to which the Supreme Court decision of 1857, which denied African Americans the right to citizenship, was overturned.
