Azerbaijan Supreme Court Upholds Verdict for Former Ukrainian Deputy Minister
The Supreme Court of Azerbaijan has rejected the cassation appeals filed by the defense and the victims in the case of Konstantin Kucher, the former Deputy Minister of Defense Industry of Ukraine, who was convicted alongside Oleg Krapivin (also known as Oleg Bakinsky).
As reported by Report, the decision was made during a session chaired by Judge Rashad Abdulov.
During the session, the prosecutor also withdrew their cassation protest.
It should be noted that Oleg Bakinsky was detained by police in 2024 in Baku on charges of hooliganism against a Russian citizen. He was charged under Article 221.3 (hooliganism involving the use of weapons or objects used as weapons, coupled with violence against the victim or destruction or damage to another's property) of the Criminal Code of Azerbaijan. Later, he was also charged under Article 178.4 (fraud causing damage on an especially large scale).
Konstantin Kucher, who served as Deputy Minister of Defense Industry of Ukraine for aviation issues from 2010 to 2011, is also a defendant in the case. The victims are recognized as ОАО 'Aviazapchast', ООО 'Promyshlennye Postavki Kazakhstan', and Valery Zakharenkov, the owner of 'Aviazapchast' and an employee of the Federal Security Service (FSB) of Russia.
As a reminder, according to the verdict of the Baku Court for Serious Crimes, Article 70 (conditional sentencing) of the Criminal Code was applied to Oleg Bakinsky. He was sentenced to a conditional term of 2 years and 6 months with a probation period of 6 months.
The other defendant, Konstantin Kucher, was acquitted of the charge under Article 178.4 of the Criminal Code. However, he was found guilty under Article 221.3 of the Criminal Code and sentenced to imprisonment for 2 years and 6 months.
Subsequently, an amnesty act was applied to both Oleg Krapivin and Konstantin Kucher. Under the amnesty, Oleg Krapivin was released from conditional sentencing, while Konstantin Kucher's sentence was reduced by 6 months.
